Terms of Service
Effective date: October 28, 2026
These Terms of Service ("Terms") govern your access to and use of the NumberAlive website, dashboard, API and related services (together, the "Service"). By creating an account, buying credits or using the Service, you agree to these Terms.
1. Eligibility and business use
The Service is for businesses. You must be at least 18 years old and able to form a binding contract. If you use the Service for an organization, you represent that you have authority to bind it, and “you” includes that organization. You may not use the Service for personal, family or household purposes, or if applicable law prohibits you from using it.
2. Your account
Give us accurate information and keep it current. You are responsible for your password, your API keys and everything done under your account. Tell us right away at [email protected] if you suspect unauthorized use. One account is one customer: accounts have no sub-accounts and no right to resell the Service. We may suspend or limit an account when information appears false, when we see abuse or a security risk, or when the law requires it.
3. The Service
NumberAlive checks US and Canadian phone numbers and returns results such as line type, carrier, whether a number is deactivated or suspended, whether it appears on a litigator or do-not-call list, duplicates, and appended details such as time zone and location. You choose which checks to run and which results to keep or remove. You can upload a CSV list in the dashboard, check a single number, or call the API.
The Service depends on carrier data and data providers outside our control. A result is a snapshot at the time of the lookup. We may change, limit or discontinue features, and will give notice when reasonably practicable.
4. Credits, payment and auto top-up
The Service runs on prepaid credits. Each check spends credits according to the options you choose, and the price and the estimated credit cost are shown before you run a list. A lookup that fails on our side, and numbers that are invalid or could not be checked, do not spend credits. Credits do not expire.
Credits are paid for by card through our payment processor. You authorize us and the processor to charge your selected payment method for the purchases you make. If you turn on auto top-up, you authorize us to charge your saved card the amount you chose whenever your balance falls below the threshold you set, up to the monthly limit you set. You can change or turn off auto top-up at any time on the billing page, and a declined charge turns it off. Prices are in US dollars and do not include taxes, which you are responsible for. We may change prices for future purchases.
Purchases and credits are non-refundable, except where the law requires otherwise or where these Terms say so. If we end your account for a reason other than your breach of these Terms, we will refund the value of your unspent credits.
5. Your data
You keep ownership of the lists, phone numbers and other data you submit (“Your Data”). You grant us and our service providers a limited license to host, copy, process and transmit Your Data only as needed to provide, secure and support the Service and to meet legal obligations. To perform checks, phone numbers are sent to the data providers that run them.
You represent that you have the right to submit Your Data and to have us process it as you instruct, including every notice, consent and lawful basis the law requires.
We keep your lists, result files and the contacts created from them in your account until you delete them. You can delete a list at any time. Contacts stay until you ask us to delete them or close your account: email [email protected] and we will delete them. We may keep billing, security and audit records as the law and our legitimate business needs require.
6. Results and your compliance responsibilities
NumberAlive is a data-hygiene tool. It is not legal advice, and using it does not make your calls or messages lawful. Results can be delayed, incomplete or wrong, including false positives and false negatives. Litigator and do-not-call results come from third-party sources and are not clearance to contact anyone. You remain solely responsible for obtaining and documenting consent, honoring opt-outs and do-not-call requests, and complying with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, state laws, carrier rules and every other law that applies to your outreach.
You may not use results as a “consumer report” under the Fair Credit Reporting Act, or to decide eligibility for credit, insurance, employment, housing or any similar purpose.
7. API use
The API is part of the Service and is subject to these Terms. Keep your keys confidential and revoke any key you think was exposed; requests made with your keys are treated as yours. Respect the documented rate limits. We may throttle or block traffic that threatens the Service, and we may suspend a key that is misused.
8. Acceptable use
You may not:
- use the Service or its results unlawfully, or to harass, stalk, threaten or locate individuals;
- upload data you do not have the right to use, or use results to avoid do-not-call, consent or opt-out obligations;
- resell, sublicense or redistribute the Service or its results, or use results to build or support a competing lookup, verification or data service, except under a separate written agreement with us;
- collect numbers by systematic enumeration, or scrape the Service to build a database;
- probe, disrupt, reverse engineer or gain unauthorized access to the Service or another account; or
- bypass or interfere with billing, credits, rate limits, security or other controls.
Our Acceptable Use Policy is part of these Terms and gives more detail. Text messages we send you are covered by our SMS Terms.
9. Third-party services
The Service relies on third parties such as carriers, data providers, payment processors, email delivery and hosting. Their terms govern their services. We are not responsible for a third party's outage or change, and it may affect the Service.
10. Intellectual property
We and our licensors own the Service, its software, documentation, branding and related intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes. Feedback you choose to give us may be used without restriction or payment, but we will not name you as its source without your permission.
11. Suspension and termination
You may stop using the Service at any time, and you may close your account by emailing [email protected]. We may suspend, limit or terminate access when reasonably necessary to prevent harm; investigate suspected fraud, abuse, security issues or legal violations; comply with law; address nonpayment; or enforce these Terms. When appropriate we will give notice and a chance to fix the problem. Sections that by their nature should survive termination will survive, including payment, ownership, disclaimers, liability limits and indemnity.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any result will be accurate, complete or current. The Service and its results are not legal advice.
13. Limitation of liability
To the fullest extent permitted by law, neither NumberAlive nor its affiliates, personnel, licensors or service providers will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill, data or business interruption, arising from the Service, even if advised of the possibility. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid us for the Service during the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so they may not apply to you.
14. Indemnification
To the fullest extent permitted by law, you will defend, indemnify and hold harmless NumberAlive, its affiliates, personnel, licensors and service providers from claims, losses, penalties, costs and expenses (including reasonable attorneys' fees) arising from Your Data, your calls, messages and outreach, your violation of these Terms or the law, or your infringement of another person's rights.
15. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. The state and federal courts located in Colorado have exclusive jurisdiction over disputes arising from these Terms or the Service, and each party consents to those courts. Before filing a claim, you agree to contact us and try in good faith to resolve the dispute informally for at least 30 days. Nothing in this section prevents either party from seeking emergency injunctive relief.
16. Changes and general terms
We may update these Terms by posting a revised version and updating the effective date. Material changes may also be announced in the Service or by email. Continued use after a change takes effect is acceptance. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger or sale. If a provision is unenforceable, the rest stays in effect. A waiver must be in writing. These Terms and any written addendum we sign with you are the entire agreement about the Service.
17. Contact
